A Pennsylvania woman has filed a personal injury lawsuit after she claims that one of her body parts was permanently damaged during a trip to a local mall. According to sources like The Pennsylvania Record, the complaint was filed on February 26 at the Philadelphia Court of Common Pleas against Indianapolis-based retailer Finish Line Inc.
Daphne Cox was reportedly at a Finish Line store in the Franklin Mills Mall last March with her spouse when a small credit card machine fell on her foot as she was paying for her merchandise. The lawsuit alleges that the store was negligent and careless in permitting a dangerous and defective piece of equipment inside the business even when it was obvious that customers would be at risk. Cox's lawyer also declared that Finish Line should have warned its customers about the faulty device.
The plaintiff purportedly sustained injuries to her left foot and toes. She said that as a result of the incident, she endured nerve damage and had to participate in physical therapy. Her personal injury lawyer said that to this day, his client continues to suffer financially and physically.
She is is seeking $50,000 in damages. No word has been released as to when the case will go to trial.
